These Terms and Conditions apply whenever The Hobby Australia Cards and Collectables Pty Ltd ("The Hobby Australia", "we", "us") purchases trading cards or collectables ("items") from a seller ("you"). By submitting our Trading Card Purchase Form, accepting an offer, or delivering items to us for sale, you agree to these terms.
1. Your obligations as the seller
- Ownership. You warrant that you are the sole legal owner of the items being sold, that you have full authority to sell them, and that no other person or party holds any ownership interest, security interest, or other claim over them.
- Authenticity. You warrant that, to the best of your knowledge, the items are genuine and are not counterfeit, altered, trimmed, recoloured, or otherwise tampered with.
- Accurate description. You must describe the items and their condition accurately and disclose any known damage, defects, or alterations before a sale is agreed.
- Lawful sale. You confirm the items are not stolen, subject to any dispute, or connected to any unlawful activity. We cooperate fully with law enforcement in relation to suspected stolen property.
- Age and identity. You must be at least 18 years of age (or have a parent or guardian conduct the sale) and, where requested, provide photo identification. Identification details may be recorded as part of the purchase record.
- Payment details. You are responsible for providing correct payment details (bank account, PayPal, or PayID). We are not liable for payments sent to incorrectly supplied details.
2. Delivering items to us
In store
You may complete the sale in person at our store. Items are inspected and their condition confirmed with you at the time of sale.
By post
- Post items to: The Hobby Australia, PO BOX 1319, Werribee Plaza, Hoppers Crossing, VIC, 3029.
- Postage is at your own cost. Items remain your property and at your risk until they are received and accepted by us — we strongly recommend tracked and insured postage.
- Package items securely. We are not responsible for damage that occurs in transit.
- Include your name and contact details with the shipment so we can match it to your purchase form.
3. Our obligations
- Assessment. We will inspect and verify the items promptly after receipt, and confirm their condition against what was described or shown to us.
- Payment. Once the items have been received and their condition confirmed, we will pay the agreed amount to your nominated bank account, PayPal account, or PayID. Payments are normally processed within 2 business days of confirmation.
- Communication. We will contact you using the details you provided if there is any issue with the items, their condition, or your payment details.
- Privacy. Your personal and payment details are used only to complete the purchase and meet our record-keeping obligations, and are handled in accordance with our Privacy Policy.
4. Offers, condition, and price adjustments
- Offers we make from photos, lists, or descriptions are conditional on the items matching that information on inspection.
- If the condition or authenticity of an item differs from what was described, we may revise our offer or decline to purchase the item. We will contact you before proceeding on revised terms.
- Unless otherwise stated, offers remain open for 7 days from the date they are made.
5. Declined or withdrawn items
- If we decline posted items, or you withdraw from the sale before payment, we will return the items to your nominated address. Return postage may be at your cost unless we agree otherwise.
- Items left unclaimed for more than 90 days after we have asked you to collect them or confirm a return address may be treated as abandoned to the extent permitted by law.
6. Title and risk
Ownership of the items passes to The Hobby Australia when payment is made. Risk in posted items passes to us when we take receipt of them.
7. General
- These terms are governed by the laws of Victoria, Australia.
- If any part of these terms is found to be invalid, the remainder continues to apply.
- We may update these terms from time to time; the version published on this page at the time of your sale applies.
